The Opportunity

The Supervisor, Prosecutions is responsible for supervising the prosecutors who handle and prosecute cases before the Ontario Court of Justice under the Provincial Offences Act, Charter of Rights and Freedoms, Highway Traffic Act, Compulsory Automobile Insurance Act, Building Code Act, Planning Act, Fire Protection and Prevention Act, Contraventions Act, and municipal by-laws, as well as directly prosecuting more complex files and Part III matters under those Acts.  Additionally, the role is responsible for handling more complex prosecution appeals to the Ontario Superior Court of Justice and ensuring the Town is represented at municipal hearing tribunals.  The role upholds and implements the Town’s obligations to prosecute matters to the standards required by the Memorandum of Understanding with the province, including the fair administration of justice and proper exercise of prosecutorial discretion.  The role liaises with multiple internal Town departments, external enforcement agencies, and other municipal and provincial prosecution counterparts, and the role ensures prosecutors’ obligations to provide disclosure, keep records and provide timely communication are met.  The role is responsible for implementing new initiatives such as the download of Part III provincial prosecutions to the municipality, camera offences, and virtual/ hybrid court procedures, including procurement of and upgrades to technological requirements to deliver prosecution services.

COVID-19: In consideration of the current pandemic and Public Health orders, the Town of Caledon is providing limited in-person services as Town Hall is open to the public by appointment only. The successful candidate for Supervisor, Prosecutions will be required to work a flexible schedule, including in the office, remotely and after hours (as required).

The Ideal Candidate

We are seeking a legal professional with a post-secondary diploma in paralegal studies, law or closely related field, or law degree and certification/ license in good standing with the Law Society of Ontario, to practice law or provide legal services as a lawyer or paralegal. Our ideal candidate has a minimum 5 years related experience in law, prosecutions or a closely related field, with 2 years supervisory experience or the equivalent in progressive prosecution experience and demonstrated leadership and experience in conducting trials and courtroom procedure.

The ideal candidate will have detailed working knowledge of the rules of evidence, the rules of civil procedure, the principles of sentencing and reasonable prospect of conviction evaluation and strong understanding of or demonstrated ability to learn relevant statutes. The ideal candidate will be proficient in MS Office (Word, Excel, Outlook) and knowledge of ICON, CAMS, ZOOM/ virtual trials and Quicklaw and have the ability to make sound judgments regarding the sufficiency of charges in law, whether to proceed to trial or to withdraw charges and to effectively communicate and rationalize the validity of such decisions. We are seeking an individual with superior legal research skills, excellent verbal and written communication skills with the ability to ensure suitable agreements and decisions are reached, a demonstrated ability to exercise significant discretion and sensitivity involving regular access to confidential data, and excellent organizational skills with specialized attention.

This position offers a salary range of $88,556.75 - $104,166.32 plus a competitive benefit package.

Satisfactory passing of a criminal record check, and proof of qualifications will be required of any successful candidate(s) for this position.
